1. INTRODUCTION This document (together with all other documents mentioned below) sets forth the terms and conditions regarding the use of the internet and the purchase of goods through this website (hereinafter referred to as "Terms"). The Customer must read the Terms, our Cookie Policy, and our Privacy Policy (collectively referred to as "Data Privacy Policy") before using the internet system. When you place an order through these internet systems or the website, you, our valued Customer, accept that you have given your explicit consent to be bound by these Terms and the Data Privacy Policy, and you maintain your declaration and consistency. If the Customer does not accept all the Terms and the Data Privacy Policy, they should not use the internet system. These Terms and the Data Privacy Policy may be changed. It is the Customer's responsibility to read them regularly, and the Terms and Data Privacy Policy in effect at the time the internet system is used or the Contract is formed (as explained below) will be valid for the Customer. 2. OUR INFORMATION The sales of goods made through this website are conducted by RYDER ACT TEXTILE CORPORATE SERVICES TOURISM INDUSTRY AND TRADE LIMITED COMPANY, a Turkish company registered at Antalya Trade Registry with the registration number 100687 and tax number 7351158332, located at Erenköy mah. YOUR INFORMATION AND VISITS ON THE WEBSITE The Customer must share personal information to purchase the desired product. The information or personal data you share with RYDER ACT. is not stored according to the Data Privacy Policy. It is accepted that all information shared by the Customer with RYDER ACT. in the internet systems is accurate and true, and it is assumed that business information and personal data have been deleted. If the Customer explicitly expresses their interest to RYDER ACT., RYDER ACT. may inform the Customer about the latest collections, catalogs, campaigns, and special offers via mail, email, and/or SMS. 4. USE OF THE WEBSITES By using the internet system and/or placing any order through the website; the Customer agrees to: 1. Use the internet systems only for legitimate requests or orders, 2. Not to place unrealistic, false, or fraudulent orders; RYDER ACT. has the right to cancel the order if a reasonable belief arises regarding such an order, 3. Provide accurate and up-to-date email, postal, and/or other contact information to RYDER ACT., and in case it is necessary, the Customer has accepted that RYDER ACT. can communicate with the Customer using this information (see the Data Privacy Policy). If the Customer does not provide all the necessary information to RYDER ACT. for placing an order, RYDER ACT. may complete the participation. When the Customer places an order through the website, they confirm that they are at least 18 years old and have the legal capacity to enter into a contract. 5. AVAILABILITY OF SERVICES The products offered on this website are only suitable for delivery within the borders of the Republic of Turkey. 1. FORMATION OF THE CONTRACT The Customer must follow the online purchasing process and click on the "Confirm Payment" option to place an order. After doing this, the Customer receives an email confirming that the order has been received ("Order Confirmation"). In a subsequent second email, the Customer is informed that the order has been accepted and is being shipped ("Delivery Confirmation"). If such confirmation is not provided to the Customer by RYDER ACT., the Contract is deemed not to have been formed. 2. AVAILABILITY OF PRODUCTS All orders are subject to stock availability. In case of supply shortages or if the product is no longer in stock, RYDER ACT. reserves the right to inform the Customer about similar or different category and value substitute products that can be ordered. If the Customer does not wish to order substitute products, the entire amount paid for the unwanted substitute product will be refunded to the Customer by RYDER ACT. 3. REJECTION OF ORDER RYDER ACT. reserves the right to withdraw any product from its website and/or to remove or correct any material or content on the website at any time. Although RYDER ACT. continues to make all reasonable efforts to process all orders received, it reserves the right to refuse to fulfill or confirm an order in the event of unusual circumstances occurring after a payment has been processed or after the Order Confirmation has been sent to the Customer. RYDER ACT. shall not be liable to the Customer or any third party for any withdrawal of any product from the website, any removal or correction of any material or content on the website, or for its refusal to fulfill or confirm an order after sending the Order Confirmation. 4. DELIVERY RYDER ACT., depending on stock availability (see above point 7) and as long as there are no unusual circumstances, will deliver orders with a broken confirmation by the delivery dates specified in the payment confirmation, and for orders without a specified estimated delivery date, within a maximum of thirty (30) days from the Order Confirmation amount. In the event of a delay due to circumstances beyond RYDER ACT.'s control regarding the supply of products, RYDER ACT. will inform the Customer as soon as possible and will take steps to minimize the burden of the delay. RYDER ACT. shall not be liable for delays caused by circumstances beyond its control. However, in the event of a significant risk of delay, the Customer may contact RYDER ACT. to terminate the Contract and may receive a refund for the products for which payment has been made but not received. The virtual gift card will be sent on the date specified by the Customer when the order is placed. Except for the virtual gift card that will be delivered immediately upon registration by the Customer, no deliveries will be made on Saturdays, Sundays, or public holidays. The Customer is deemed to have accepted this delivery service in the package of RYDER ACT.'s delivery distributions or in RYDER ACT.'s records. To prevent or minimize the risk of damage to the Customer's home or belongings, RYDER ACT. requests that the Customer remove any items or anything that may be damaged and accept the delivery parts into their home in the most appropriate manner possible. RYDER ACT. cannot be held responsible for situations where reasonable precautions can be taken to prevent or minimize the risk and where items can be safely removed, provided that it is not due to RYDER ACT.'s negligence. In this case, the "delivery" or "delivered" status must be confirmed by the Customer or a third party designated by the Customer, and this can be proven by signing the document belonging to the specified delivery parts. The virtual gift card will be delivered via email specified by the Customer on the delivery date of the existing virtual card, in accordance with the Terms and Conditions regarding the Gift Card. 5. INABILITY TO DELIVER If delivery of the product(s) is not possible, the product(s) will be returned to the warehouse. In case of possible exhaustion, the Customer will be informed about the whereabouts of the product subject to the order and how the delivery can be rescheduled. The Customer must be at the delivery location at the agreed time; otherwise, they should contact RYDER ACT. to reschedule the delivery for another suitable day. If the delivery of the product subject to the order is not provided and no fee disruption occurs due to RYDER ACT., and if the Customer does not contact RYDER ACT. for delivery within the following fifteen (15) days, the Customer's Contract may be terminated on the grounds of breach. As a result of the termination of the Contract, all payments received from the Customer, including delivery costs (except for any additional costs arising from any delivery method requested by the Customer other than the standard delivery method offered by RYDER ACT.) will be refunded to the Customer, without any unreasonable delay. In addition, the Customer should not forget that this cost may be reflected to the Customer by RYDER ACT. as an additional cost arising from the termination of this Contract. This provision does not apply to the delivery of virtual gift cards, as the delivery of virtual gift cards is subject to the provisions of Article 9 regarding the Gift Card. 6. RISK AND OWNERSHIP The risk of any benefit and damage related to the products will be under the responsibility of RYDER ACT. until the delivery is accepted by the Customer. The ownership of the products passes to the Customer upon delivery of the product to the Customer or to the person at the delivery location. (transfer of ownership) 7. PRICE AND PAYMENT The price of the products is as specified on the website. RYDER ACT. makes every effort to ensure that all prices on the website are accurate; however, errors may occur in this regard. In the event of a pricing error in the price ordered by the Customer, RYDER ACT. will inform the Customer as soon as possible and will offer the Customer the option to confirm the order at the correct price or to cancel the order. If RYDER ACT. cannot reach the Customer, the amount paid for the products will be refunded to the Customer without canceling the order. If the pricing error is obvious and clear, and it is understood that the price registered on the website is clearly incorrect, RYDER ACT. will not be obliged to complete the sale of the products at the incorrect (normally lower) price, even after sending the Delivery Confirmation to the Customer. Prices on the website include VAT and taxes but do not include delivery charges, and this charge will be added to the total amount specified in the Shopping Guide to determine the total order fee. Prices may change at any time; however, orders affected by the price at which the Order Confirmation is sent to the Customer will not be affected (except as stated above). Therefore, price adjustments for previous orders are not allowed (except in the case stated above). The Customer completes the shopping by adding all the products they wish to purchase to the shopping cart, and the next step is to finalize the order and payment process. To do this, the Customer must follow the steps related to the purchase process, and all required information must be completed or confirmed. Additionally, the Customer may make changes to the order details before the payment process during the purchasing process. After the order is placed and before the payment is confirmed by the Customer, information regarding the essential features of the purchased product, the total price including product taxes, the conditions for the use of the right of withdrawal, the duration, regime, and the return provisions for the seller will be provided to the Customer, or in exceptional cases, information regarding the loss of the right of withdrawal will be presented to the Customer in the form of an order summary. Detailed explanations regarding purchasing policies are available in the Shopping Guide. Additionally, if the Customer is a registered user, all details of their orders will be recorded in the "My Account" section. Payments are made through payment methods on the website and applications, via credit cards and debit cards. Similarly, the Customer may pay for all or part of their order with a gift voucher card for use in Turkey issued by RYDER ACT TEXTILE CORPORATE SERVICES TOURISM INDUSTRY TRADE LTD. ŞTİ. To prevent unauthorized access, the Customer's credit card information is encrypted. RYDER ACT. requests authorization from the Customer's card to confirm that there is a sufficient available limit for the completion of the transaction. The collection related to the payment will be made by RYDER ACT. at the moment the order is confirmed. [H1] When the Customer clicks the "Payment Confirmation" button, it is deemed verified and approved that the Customer is the owner of the credit card used or the legal holder of the gift card or credit voucher card. The credit card is subject to the terms and authorizations of the issuing institution; however, RYDER ACT. will not be liable for any delays or non-delivery if the institution that issued the Customer's card does not authorize the payment, and the completion of the Contract will not be possible. 8. INVOICE The invoice will be sent to the Customer at the latest, along with the delivered products. RYDER ACT. reserves the right to provide invoices in accordance with e-invoice/e-archive regulations. 9. IMMEDIATE PAYMENT The Immediate Payment feature (hereinafter referred to as "Immediate Payment") is designed to allow the Customer to make purchases online without the need for delivery, invoicing, and payment to be received. Immediate Payment is made available to the Customer in the View Cart section. To use the Immediate Payment option, the Customer must register their credit card and/or debit card for payment. The Customer can click on the "Save Card Information" option for any order to allow RYDER ACT. to process the payment with any card accepted by RYDER ACT. Thus, the card number, the name of the cardholder as it appears on the card, and the expiration date of the card will be visible. The Customer must accept the Data Privacy Policy and Terms to save the card and use the Immediate Payment feature. When the Customer agrees to use the Immediate Payment feature, they authorize RYDER ACT. to consolidate the payment for purchases from the card linked to these relationships. Card usage is subject to the agreement between the Customer and the card-issuing institution in all cases. In the Immediate Payment feature, the Customer can register as many cards as they wish; however, each software must have been used for payment at least once. If the Customer wishes to open card information for multiple cards, the last information will be the "Preferred Card" on their card, and by default, payments for Immediate Payment purchases will be collected from there. However, the Customer can always see the Preferred Card in the My Account section of the website. To use the Immediate Payment feature, the only thing the Customer needs to do is click the "Immediate Payment" button seen in the Shopping Cart section. Immediately after pressing the button, a screen will appear that includes delivery, invoicing, and payment for the purchase. The information displayed on this screen cannot be changed; therefore, if there are incorrect details, the Customer must complete the purchasing process. The Customer should not use the Immediate Payment feature for purchasing processes using different information. The Preferred Card associated with Immediate Payment can be changed in the My Account section of the website. 10. PURCHASE WITHOUT MEMBERSHIP The option to purchase products without being a member on the website is also available. In such a purchase process, only the information necessary for the execution of the order is requested from the Customer. When the Customer completes the purchasing process, they are offered the options to register as a user or to continue as a user without registration. 11. VALUE ADDED TAX All sales transactions made on the internet are subject to Value Added Tax (VAT), except for applicable final exemptions subject to the Customer's divorce, as stated in the applicable legislation. 17. RETURN POLICY 17.1. Legal Right of Withdrawal The Customer has the right to withdraw from the Contract without stating any reason within five (5) days following the formation of the Contract (except for the group of products for which the right of withdrawal cannot be exercised as specified in Article 17.3 below). The purchased products can be returned directly via Yurtiçi Kargo. The withdrawal period ends five (5) days after the Customer or a third party (other than the courier) designated by the Customer has received the goods, or in the case of multiple products delivered separately with a single order, five (5) days after the last product has been received by the Customer or a third party (other than the courier). To exercise this right of withdrawal, the Customer must notify RYDER ACT. of their intention to withdraw from the Contract, either in writing or through other means provided on our website. The Customer can inform RYDER ACT. by sending an email to contact@ryderact.com. Additionally, the Customer can notify RYDER ACT. by sending written notifications to Erenköy mah. Çelebi sok. No: 11 iç kapı: 1 Kadıköy/Istanbul Turkey. The Customer may use the sample withdrawal form attached to these Terms, although it is not mandatory. To use the right of withdrawal, it is sufficient for the Customer to inform RYDER ACT. before the expiration of the withdrawal period. In the case of exercising the right of withdrawal, the product exchange can be made at any RYDER ACT. store within five (5) days from the notifications regarding the withdrawal, in accordance with Article 17.3 of this Contract. The Customer can reach RYDER ACT. through the communication systems on the website or by calling the toll-free customer service line at 0850 885 45 54 or from their mobile phone (cost varies according to mobile operators) at 0850 885 45 54 or by sending an email to contact@ryderact.com. Refunds will be made without any delay, within a maximum of five (15) days from the date of the withdrawal notification. If the Customer prefers a return method by cargo, any extra costs incurred by RYDER ACT. will not be included in the amount to be refunded to the Customer. The consequences of using the right of withdrawal are as follows: If the Customer terminates the Contract, RYDER ACT. will refund all payments received from the Customer, including delivery costs (except for any additional costs arising from any delivery method requested by the Customer other than the standard delivery method offered by RYDER ACT.). RYDER ACT. will refund the Customer using the same payment method used for the purchase, and in no case will the Customer be required to pay any additional fees as a result of such a refund. The Customer must return the products to RYDER ACT. through any RYDER ACT. store or by the shipping fee recorded by RYDER ACT., without any delay, within five (5) days from the use of the right of withdrawal. The Customer can return or exchange their products within this five (5) day period. The Customer is only responsible for any depreciation in the value of the products due to necessary checks for their nature, characteristics, and distribution. 17.2 Contractual Right of Withdrawal In addition to the legal right of withdrawal mentioned in Article 17.1 above, the Customer is not granted the right to return products without stating any reason (except for gift cards and the products mentioned in Article 17.3 below) within five (5) days from the Pricing Confirmation. The exchange of gift cards must be carried out as specified in the Terms and Conditions regarding the Gift Card. In returns made under the contractual right of withdrawal, the costs incurred for product exchanges are the responsibility of the Customer, except for the cases where the return is made to a RYDER ACT. warehouse in Turkey or through variable shipping by RYDER ACT. The Customer can use the right of withdrawal arising from the Contract in accordance with the procedure in Article 17.1. However, the Customer must notify RYDER ACT. at the end of the period during which the right of withdrawal can be exercised, and in any case, the products must be delivered within five (5) days from the date of the withdrawal confirmation. Refunds will be planned without any delay, within a maximum of five (15) days from the date of the withdrawal notification. RYDER ACT. will make the refund using the same payment method used for the purchase. This contractual right of withdrawal does not affect the legal right of withdrawal. 17.3 General Provisions (Applicable to both legal and contractual withdrawal rights) The Customer cannot use the right of withdrawal in contracts for the delivery of any of the following: 1. Contracts for goods that are made to the Customer's specifications or are clearly personalized at the time of payment. 2. Contracts for books, digital content, and computer consumables that have been unsealed after delivery, in the case of protective elements such as packaging, tape, sealing, and packaging. 3. Contracts for the delivery of goods that have protective features such as packaging, tape, sealing, and packaging, which are unsuitable for exchange, health, and hygiene (underwear, swimsuits, etc.). The Customer may inspect the products to determine their conditions, characteristics, and accuracy after the withdrawal. The products can be handled in an acceptable manner and are in a reasonably acceptable condition in stores. If the Customer's handling condition exceeds acceptable reasonable temperatures and the products are visible or values decrease, this difference may be deducted from the refund to the Customer during the use of the right of withdrawal, or the Customer may be liable to pay a balance amount to RYDER ACT. for the depreciated values. The Customer must return the products to RYDER ACT. with their original packaging, instructions, and other documents. In any case, when returning the product, the invoice received upon delivery or documents related to the changes in e-invoice/e-archive regulations must be sent along with the product. A summary of how the right of withdrawal can be used will be shared with the Customer upon receipt of the Customer's information. RYDER ACT. allows the Customer to return any product to any RYDER ACT. store that has the same product details as the product group they wish to return. Thus, the Customer must go to the store and present the product and the invoice delivered with it or the document related to the publication of the e-invoice/e-archive regulations. B. Returns by Cargo During the return of products through RYDER ACT.'s delivery, the Customer must contact RYDER ACT. through the form on the website to organize the process of picking up the product from the Customer's home. Instructions in the "RETURNS" section on the website should be provided to the Customer, and the product must be sent in the same package. In the case of purchasing any product without being a member, the shipping fee can also be requested by calling the toll-free customer service line at 0850 885 45 54 or from their mobile phone (cost varies according to the Customer's mobile operators) at 0850 885 45 54. None of the above options will incur any additional charges for the Customer. If the Customer does not use any of the available free return methods, they will be responsible for the return costs. The Customer may wish to return the products to RYDER ACT. with the shipping cost paid by the recipient, and they may be held responsible for the associated costs. RYDER ACT. will inform the Customer whether they are entitled to a refund of the amounts paid after the products have been inspected. Refunds will be made within the legal period of the right of withdrawal, and all products in the relevant package will be re-evaluated. Refunds will be made as soon as possible and in any case, within five (15) days from the notification of the intention to withdraw to RYDER ACT. Refunds will always be made using the payment method used for the purchase. The Customer is responsible for the shipping risks when returning the products to RYDER ACT. as specified above. 17.4 Replacement of Defective Products RYDER ACT. offers the Customer the right to replace defective products in addition to their legal rights. The Customer must contact RYDER ACT. via the customer service line at 0850 885 45 54 or through the website to ensure the compliance of the product with the Contract at the time of delivery. The Customer must return the product to RYDER ACT. with the invoice provided with the product at the time of delivery. RYDER ACT. will send a notification to the Customer regarding the replacement of the product or the right to a refund (if applicable) via email after thoroughly inspecting the returned product within a reasonable time. As a customary practice, refunds or product replacements will be made as soon as possible and in any case, within five (15) days from the date the Customer is notified via email regarding their right to replace or refund the defective product. In the case of products returned as defective, if the defect is covered, all payments related to the product will be refunded to the Customer, including the delivery cost incurred when sending the product to the Customer and the costs incurred during the return of the product. Refunds will always be made to the credit card used by the Customer for the payment of the order. This provision does not affect the Customer's legal rights. 18. LIABILITY AND WAIVER No provision in these Terms shall limit or exclude RYDER ACT.'s liability for: 1. Personal death or injury caused by RYDER ACT.'s negligence; 2. Fraud or fraudulent misrepresentation; or 3. Any other situation where it would be illegal or unlawful for RYDER ACT. to limit or exclude liability. RYDER ACT. is liable to the Customer for foreseeable loss and damage caused by its own actions. RYDER ACT. shall be liable for losses and damages incurred by the Customer as a result of a breach of the Contract, which are foreseeable or arise from the use of reasonable care and skill; however, RYDER ACT. shall not be liable for any unforeseeable loss or damage. In the event of a loss or damage occurring, if it is obvious or if the Contract indicates that both RYDER ACT. and the Customer could foresee it, for example, when the Customer discussed this with RYDER ACT. during the sales process, the loss or damage may be added as foreseeable. RYDER ACT. shall not be liable for commercial losses. RYDER ACT. only offers products for individuals and personal use. The Customer agrees, declares, and undertakes that they will not hold RYDER ACT. liable for any loss of profit, loss of business, business interruption, or loss of business opportunity due to the Customer's use of the products for any commercial, business, or resale purposes. Due to the potential for errors in this internet environment and the connection and transmission of digital links, unless otherwise stated on the website, RYDER ACT. makes no guarantee regarding the storage and security of information transmitted or obtained from the website. Providing the Customer with products that comply with the Contract is RYDER ACT.'s contractual obligation; however, without affecting this obligation and to the extent permitted by law, all product descriptions, information, and materials published on this website are provided "as is" and without any express, implied, or statutory warranty. When you enter into a contract as a Customer, RYDER ACT. ensures that the products sent to the Customer are as follows: (i) the products conform to the descriptions provided by RYDER ACT. and the models specified on the website, (ii) the products are suitable for normal use systems of similar types, and (iii) the products demonstrate the quality and performance that can be reasonably expected under normal conditions of the same type. RYDER ACT. guarantees that any product purchased by the Customer in this internet environment is reasonable and suitable for its type, and generally provides all products at a reasonable and appropriate quality. To the fullest extent permitted by law, but excluding those legally excluded from the Customer's perspective, no other express or implied warranty is included with the products on this website under RYDER ACT.'s liability. The products sold by RYDER ACT. (including handmade products) generally have the natural characteristics of the materials used in inexpensive production. Natural characteristics such as texture, shape, seams, and color appearances should not be classified as defects or flaws. Inconsistencies in these natural characteristics are to be expected and should be reasonably accommodated. Despite RYDER ACT.'s selection of the best quality products, natural characteristics are inevitable and can be considered part of the product's own appearance. Nothing in this section affects the Customer's legal rights or the right of withdrawal arising from the Contract. 19. INTELLECTUAL PROPERTY RIGHTS The Customer acknowledges that all copyrights, trademarks, and other intellectual property rights in all materials and content presented on the internet are always owned by RYDER ACT. or its authorized agents. The content provided by the Customer may only be used as expressly authorized by RYDER ACT. or its authorized sellers. This does not prevent the Customer from using the internet system to the extent necessary for the compilation of any order or Contract information. 20. VIRUSES, VIRTUAL PIRACY, AND OTHER CYBER CRIMES The Customer agrees to avoid loading viruses, trojans, worms, logic bombs, or other malicious or technologically harmful materials that may harm the use of this internet system. The Customer shall not attempt to gain unauthorized access to this internet system, the server hosting this internet system, or any server, computer, or database related to this website, nor shall they interfere with, damage, or destroy any data. The Customer undertakes not to attack this internet system through a denial-of-service attack or a distributed denial-of-service attack. Under these rules, the Customer may have committed a criminal offense under applicable laws. RYDER ACT. cooperates with the relevant authorities to manage and expose any such management and virtual piracy. Similarly, in the event of such a breach, the Customer's right to use this internet system will be immediately terminated. RYDER ACT. shall not be liable for any loss or damage caused by any denial-of-service attack, virus, or other software or breaches that may harm the Customer's computer, devices, or the use of this internet system or for any content downloaded from this internet distribution. 21. LINKS FROM OUR WEBSITE RYDER ACT. may not intervene with third-party websites or materials in the internet world; these links are provided for informational purposes only, and RYDER ACT. has no control or responsibility for the content of these websites or materials. Similarly, RYDER ACT. does not assume any liability for any loss or damage that may arise from the use of such links. 22. WRITTEN COMMUNICATIONS Applicable legislation requires that certain information and communications sent by RYDER ACT. to the Customer be in writing. The Customer agrees to the electronic recording of communications with RYDER ACT. in the internet systems. The Customer informs RYDER ACT. by reaching out via email or following the websites. The Customer declares that the addition of the contract acknowledges the acceptance of these electronic communication records and that all contracts, notifications, information, and other communication methods presented to the Customer electronically comply with any legal requirements that necessitate the written form of these communication channels. In this case, the Customer's legal rights are not affected. 23. NOTIFICATIONS All instructions submitted to RYDER ACT. must be in writing. The Customer expressly accepts and declares that, in accordance with Article 22 and as stated there, RYDER ACT. may notify the Customer of the order submission via email or postal address. A notification is deemed accepted when sent via email within 24 hours or within 3 days from the date the letter is sent. In the case of a letter, it will be sufficient to provide information that the letter was sent to the correct address, sealed, and delivered to the post office; in the case of an email, it will be sufficient to provide information that the email was sent to the relevant email address. 24. ASSIGNMENT OF RIGHTS AND OBLIGATIONS This Agreement between RYDER ACT. and the Customer shall bind RYDER ACT. and the Customer, as well as their successors. The Customer may not assign, transfer, or delegate the contract and the rights and obligations arising from it (except for the warranty) without prior notice. However, the Customer may transfer the warranty provided in Article 17.4 to the person acquiring the product. RYDER ACT. may assign, transfer, subcontract, or delegate the Contract, rights, and obligations arising from it at any time during the term of the Contract. To avoid doubt, such assignment, transfer, delegation, or delegation shall not impair or limit the legal rights and obligations under the contract or guarantee the direct or indirect transfer of rights to the Customer or cancel, reduce, or limit any guarantees. 25. FORCE MAJEURE RYDER ACT. shall not be held responsible or liable for any event that occurs beyond its control and causes the performance or delay of any part of this Agreement to be affected, and such events shall be added as force majeure under the Agreement. Events beyond RYDER ACT.'s control include reasonable levels of action, events, non-occurrence, removal, or accidents, and specifically include events (not limited to): 1. Strikes, lockouts, or other industrial actions. 2. Civil unrest, riots, invasion, terrorist attacks or threats of terrorist attacks, war (declared or not) or threats of war or preparations for war. 3. Fire, explosion, storm, flood, earthquake, collapse, or other natural disasters. 4. Impossibility of carrying out rail, sea, air, motor vehicle, or other public or private transport. 5. Impossibility of initiating public or private telecommunications networks. 6. Any actions, decrees, legislation, regulations, or restrictions. 7. Strikes, collapses, and accidents in any shipping, postal, or related transport operations. Any obligation of RYDER ACT. under this Agreement shall be suspended for the duration of the event beyond its control, and this period shall be added to the time for RYDER ACT. to fulfill its obligations. RYDER ACT. will make all reasonable efforts to find a solution that will allow the performance of the Agreement despite the external event. 26. WAIVER The inability of RYDER ACT. to enforce any of the rights or obligations under the Contract or any other provisions of these Terms does not mean that RYDER ACT. waives any of its rights or legal remedies. Any waiver of a default does not constitute a waiver of any subsequent defaults arising from the Contract or these Terms. No waiver of any of these Terms shall be deemed to have been made unless expressly stated and communicated in writing in accordance with the paragraph in the Notifications section. 27. SEVERABILITY If any provision of these Terms or the Agreement is determined to be invalid, illegal, or unenforceable by any competent authority, that provision shall be deemed severed from the remaining provisions, which shall remain valid to the extent permitted. 28. RIGHT TO CHANGE TERMS RYDER ACT. reserves the right to update or change these Terms from time to time. The Customer shall be subject to the current principles and Terms in effect when using the internet systems or ordering products from RYDER ACT. Any possible changes made to the Terms or Privacy Statement in accordance with the law or competent authority shall also apply to "orders made by the Customer." These changes do not affect the Customer's legal rights. 29. COMPETENT COURT RYDER ACT. reserves the right to update or change these Terms from time to time. The use of the internet distribution and contracts regarding the purchase of goods through this website shall be governed by the laws of the Republic of Turkey. Any dispute arising from the use of internet links or from such a Contract or related to it shall be subject to the jurisdiction of the courts of Turkey. If a dispute arises regarding the contract between RYDER ACT. and the Customer, the Customer may make the necessary applications to the competent Consumer Court or Consumer Arbitration Board. Nothing in this section affects the Customer's legal rights in this regard. 30. FEEDBACK AND COMPLAINTS The Customer's opinions, complaints, and feedback are important to RYDER ACT.
